Reading the passage

My broad reaction is that the writer doesn't think existing law needs the proposed expansion. Owners can restrict access themselves, and a link isn't the same as a distributed copy.

What we’re looking for

But this question asks about present copyright laws. It could be asking for a particular thing those laws already allow, rather than simply asking us to repeat the recommendation against changing them. We'll need to match the claim to the description of existing law.

Working the answers

  • A

Allowing a link to a document doesn't establish completely unrestricted use of that document. The argument distinguishes linking from unauthorized copying and distribution; it doesn't erase that distinction once a work is online.

  • B

The argument assigns control to the author who posts the document, not the person who links to it.

  • C

No rule about who may profit from distribution is stated. The discussion of permission and copying doesn't tell us that the author must be the only person who can earn money from a document.

  • D
    Correct

Existing law gives owners grounds to sue someone who distributes copies without permission (paragraph 2), even if that person didn't make the copies. Unauthorized distribution is the conduct this answer identifies; merely linking to the author's available document is the activity the writer distinguishes from it.

  • E

This proposes a change, whereas the question asks what present law allows. The writer doesn't endorse this proposal either: opposing the owners' expansion doesn't mean advocating a different change to create more freedom.
